These General Terms and Conditions (AGB) govern the contractual relationship between ECD Beyond Experience GmbH and members of the Beyond Bagatelle programme. Please read them carefully before completing your registration.

1. Scope and Operator

These Terms & Conditions apply to all contracts concluded between ECD Beyond Experience GmbH ("Beyond Bagatelle", "we", "us") and individuals who register as members of the Beyond Bagatelle programme ("Member", "you") via the website beyondbagatelle.com.

Any deviating, conflicting, or supplementary terms and conditions of the Member shall not become part of the contract, even if we are aware of them, unless we expressly agree to their application in writing.

2. Registration and Eligibility

2.1 Eligibility

Membership is open to natural persons who are at least 18 years of age and have full legal capacity. By completing registration you confirm that you meet these requirements.

2.2 Registration process

The membership contract is concluded when you complete the registration form, select a billing plan, accept these Terms & Conditions and the Privacy Policy, and your payment is successfully processed by Stripe. We will confirm your membership by e-mail.

2.3 Accurate information

You are obliged to provide truthful, complete, and up-to-date information during registration and to keep your account details current. Providing false or misleading information constitutes grounds for immediate termination (see Section 5.3).

2.4 Account security

You are responsible for keeping your login credentials confidential. You must notify us immediately at info@ecd-international.com if you suspect unauthorised access to your account.

2.5 Non-transferability

Membership is strictly personal and non-transferable. You may not assign, sublicense, or otherwise transfer your membership or any associated benefits to any third party.

3. Membership Fees and Payment

3.1 Pricing

Membership is available at the following rates, all prices in Euro (EUR) inclusive of applicable VAT:

We reserve the right to adjust membership fees. Price changes will be communicated to existing Members at least 30 days before they take effect. Continued use of the membership after the effective date constitutes acceptance of the new price. If you do not accept a price increase, you may cancel your membership before the new price takes effect (see Section 5).

3.2 Payment processing

All payments are processed by Stripe, Inc. via the Stripe Checkout interface. By completing payment you also agree to Stripe's Terms of Service. We do not store or have access to your full payment card details.

3.3 Failed payments

If a recurring payment fails, we will notify you by e-mail. Stripe will automatically retry the charge. If payment cannot be collected after reasonable retries, your membership access may be suspended until the outstanding amount is settled. Persistent non-payment constitutes grounds for extraordinary termination (see Section 5.3).

4. Right of Withdrawal

4.1 Statutory right

As a consumer under German law, you have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period begins on the day the contract is concluded (i.e. the day your payment is confirmed).

To exercise your right of withdrawal, you must inform us of your decision by an unequivocal statement sent to:

4.2 Lapse of withdrawal right — immediate service commencement

At the time of purchase you are asked to expressly consent to the membership commencing immediately upon activation, before the 14-day withdrawal period has expired. By checking the corresponding checkbox at checkout, you acknowledge that your right of withdrawal lapses upon activation of your membership, in accordance with § 356(5) BGB in conjunction with § 355 BGB.

4.3 Refund upon valid withdrawal

If you have not consented to immediate commencement (4.2), or if the service has not yet commenced, we will reimburse all payments received from you within 14 days of receiving your withdrawal notice, using the same payment method as your original transaction.

5. Cancellation and Termination

5.1 Ordinary cancellation by Member — Monthly plan

You may cancel your monthly membership at any time via your account dashboard or by contacting us. Cancellation takes effect at the end of the current billing period. Access to membership benefits continues until that date; no partial refund is issued for the remaining days.

5.2 Ordinary cancellation by Member — Annual plan

You may cancel your annual membership at any time. Cancellation takes effect at the end of the current annual billing period. The membership fee for the remaining months of the paid period is non-refundable. Access to membership benefits continues until the end of the paid period.

5.3 Extraordinary termination by Beyond Bagatelle

We reserve the right to terminate your membership with immediate effect for good cause (§ 626 BGB). Good cause includes, but is not limited to:

In the event of extraordinary termination for cause attributable to the Member, no refund of any prepaid fees will be made.

5.4 Termination by Beyond Bagatelle — ordinary

We may also terminate the membership programme entirely by giving Members at least 60 days' written notice. In this case, any prepaid fees for periods beyond the termination date will be refunded on a pro-rata basis.

7. Event Participation and Cancellation

7.1 Event access

Membership entitles you to access Beyond Bagatelle events subject to availability. Certain events may require a separate booking or ticket purchase. Membership itself does not guarantee a place at any specific event.

7.2 Member cancellation of event bookings

If you cancel a confirmed event booking, refund entitlement (if any) is governed by the specific terms communicated at the time of booking. Where no specific terms apply, no refund will be issued for cancellations made fewer than 14 days before the event date.

7.3 Cancellation of events by Beyond Bagatelle

If Beyond Bagatelle cancels an event, the following refund policy applies depending on the event type and the notice given:

In all cases of force majeure (including but not limited to natural disasters, pandemic restrictions, government orders, or venue closure beyond our control), a full refund will be issued regardless of notice period.

8. Partner Benefits and Third-Party Services

Beyond Bagatelle provides access to benefits offered by third-party partners (hotels, hospitality providers, transport operators, and others). These benefits are provided by the respective partners under their own terms and conditions and are subject to availability.

Beyond Bagatelle acts as an intermediary in facilitating access to partner benefits and is not a party to any contract concluded between you and a partner. We accept no liability for the quality, availability, or fulfilment of partner services.

Partner benefits may be modified, suspended, or withdrawn at any time without prior notice if a partner relationship ends. Such changes do not constitute a material change to the membership and do not entitle you to a fee refund, provided that the overall scope of membership benefits remains substantially unchanged.

9. Liability

9.1 Limitation of liability

Beyond Bagatelle is liable without limitation for damage caused by intent or gross negligence, for damage resulting from injury to life, body, or health, and for claims under the German Product Liability Act (Produkthaftungsgesetz).

In cases of ordinary (simple) negligence, our liability is limited to the breach of material contractual obligations (Kardinalpflichten) — i.e. obligations whose fulfilment is essential to the proper performance of the contract and on whose compliance you may regularly rely. In such cases, liability is limited to the foreseeable, contract-typical damage.

9.2 Force majeure

We are not liable for any failure or delay in performance caused by circumstances beyond our reasonable control, including but not limited to natural disasters, acts of government, pandemics, industrial action, or failure of third-party infrastructure.

9.3 Third-party content and services

We accept no responsibility for content, services, or products provided by third-party partners or linked websites. Use of partner services is at your own risk and subject to the partner's own terms.

10. Intellectual Property

All content on the Beyond Bagatelle website and platform — including but not limited to text, images, logos, videos, and software — is the property of ECD Beyond Experience GmbH or its licensors and is protected by German and international copyright law.

Your membership grants you a limited, personal, non-exclusive, non-transferable licence to access and use the platform for the purpose of utilising your membership benefits. Any reproduction, distribution, modification, or commercial use of platform content without our prior written consent is strictly prohibited.

11. Changes to These Terms

We may update these Terms & Conditions from time to time to reflect changes in our services, legal requirements, or business operations. We will notify you of any material changes by e-mail to your registered address at least 30 days before the changes take effect.

Your continued use of the membership after the effective date constitutes acceptance of the revised Terms. If you do not accept the changes, you may cancel your membership before the effective date without penalty.

12. Final Provisions

12.1 Governing law

These Terms & Conditions are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). For consumers habitually resident in another EU member state, mandatory consumer protection provisions of that state remain unaffected.

12.2 Jurisdiction

For Members who are merchants (Kaufleute), legal entities under public law, or public law special funds, the exclusive place of jurisdiction for all disputes arising from or in connection with these Terms is Stuttgart, Germany. For consumer Members, the statutory place of jurisdiction applies.

12.3 EU online dispute resolution

The European Commission provides a platform for online dispute resolution (ODR): https://ec.europa.eu/consumers/odr. We are not obliged and not willing to participate in dispute resolution proceedings before a consumer arbitration board.

12.4 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be replaced by a valid provision that most closely reflects the original intent.

12.5 Language

These Terms & Conditions are written in English. In the event of any conflict or ambiguity between an English version and any translation, the English version prevails.
