Terms & Conditions

These General Terms and Conditions (AGB) govern the contractual relationship between ECD Beyond Experiences GmbH and individuals concluding a membership in relation to the Beyond Bagatelle Program. Please read them carefully before completing your registration to apply for membership.

1. Scope and Operator

1.1 Application

These Terms & Conditions apply to all contracts concluded between ECD Beyond Experiences GmbH (“Beyond Bagatelle”, “we”, “us”) and individuals who register to apply for membership of the Beyond Bagatelle Program (“Member”, “you”) via the website beyondbagatelle.com.

1.2 Program description

The Beyond Bagatelle Membership Program (“Program”) is a paid annual subscription program operated by Beyond Bagatelle. The Program provides Members with access to curated travel packages, driving events and experiences, exclusive partner offers, and other benefits as described on the Program’s website at www.beyondbagatelle.com and in the respective membership materials.

Any deviating, conflicting, or supplementary terms and conditions of the Member shall not become part of the contract, even if we are aware of them, unless we expressly agree to their application in writing.

1.3 Travel Package T&Cs

The conditions governing the conclusion and performance of travel contracts are subject to the Terms & Conditions of ECD Beyond Experiences GmbH for Travel Packages and Ticketed Services.

2. Registration and Eligibility

2.1 Eligibility

Membership in the Beyond Bagatelle Program is open to any natural person of legal age (18 years or older) who registers and pays the applicable membership fee. Memberships are exclusively reserved for private individuals. By registering, the Member confirms that he or she is acting as a private person.

2.2 Conclusion of the Membership Agreement

By submitting a membership registration (whether online at www.beyondbagatelle.com, by e-mail, telephone, or in writing), the applicant furnishes a binding offer to conclude a membership agreement with Beyond Bagatelle. The applicant shall be bound by this offer for a period of 10 working days.

The membership agreement is concluded when you complete the registration form, select a billing plan, accept these Terms & Conditions and the Privacy Policy, and your payment is successfully processed by Stripe. We will confirm your membership by e-mail. Beyond Bagatelle reserves the right to accept or decline any membership application at its sole discretion without being required to state reasons.

2.3 Accurate information

You are obliged to provide truthful, complete, and up-to-date information during registration and to keep your account details current. Providing false or misleading information constitutes grounds for immediate termination (see Section 4.2).

2.4 Account security

You are responsible for keeping your login credentials confidential. You must notify us immediately at contact@beyondbagatelle.com if you suspect unauthorised access to your account.

2.5 Non-transferability

Membership is strictly personal and non-transferable. You may not assign, sublicense, or otherwise transfer your membership or any associated benefits to any third party.

2.6 Membership term and renewal

The membership term is one (1) year from the date of activation as communicated in the membership confirmation. The membership shall automatically renew for successive one-year terms unless cancelled by either party in accordance with Section 4.

3. Membership Fees and Payment

3.1 Pricing

Membership is available at the following rates, all prices in Euro (EUR), inclusive of applicable VAT:

We reserve the right to adjust membership fees. Price changes will be communicated to existing Members at least 60 days prior to the start of the next renewal period (Section 2.6). Continued use of the membership within the next renewal period constitutes acceptance of the new price. If you do not accept a price increase, you may cancel your membership before the new price takes effect (see Section 4).

If we offer membership at a discounted rate, the discounted rate applies exclusively to the first period (first year) of the contract / initial contract term. If the membership is subsequently renewed, the renewal will be based on the then-current standard membership fee, without the application of the discounted rate, unless we expressly state otherwise.

3.2 Payment processing

All payments are processed by the payment service provider Stripe Inc. via the Stripe Checkout interface. By completing payment, you also agree to Stripe’s Terms of Service. We do not store or have access to your full payment card details.

3.3 Failed payments

In the event of recurring payment failures, we will notify you by e-mail. Stripe will automatically retry the charge. If payment cannot be collected after reasonable retries, your membership access may be suspended until the outstanding amount is settled. Persistent non-payment constitutes grounds for extraordinary termination (see Section 4.2).

4. Cancellation and Termination of Membership

4.1 Ordinary cancellation by the Member

You may give notice of ordinary termination of your membership (whether on a monthly or on an annual billing plan) at any time via your account dashboard or by contacting us. Such termination will take effect at the end of the current twelve (12)-month membership term, provided that your notice is received by us no later than one (1) month before the expiry of that term. If notice is received later, termination will take effect at the end of the following twelve (12)-month term. Access to membership benefits continues until the effective termination date; membership fees already paid are non-refundable, unless mandatory statutory provisions provide otherwise.

4.2 Extraordinary termination by Beyond Bagatelle

We reserve the right to terminate your membership with immediate effect for good cause (§ 626 BGB). Good cause includes, but is not limited to:

In the event of extraordinary termination for cause attributable to the Member, no refund of any prepaid fees will be made.

4.3 Termination by Beyond Bagatelle — ordinary

We may also terminate the Membership Program entirely by giving Members at least 60 days’ written notice. In this case, any prepaid fees for periods beyond the termination date will be refunded on a pro-rata basis.

5. Right of Withdrawal

5.1 Statutory right

As a consumer under German law, you have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period begins on the day the contract is concluded (i.e. the day your payment is confirmed). To exercise your right of withdrawal, you must inform us by an unequivocal statement sent to:

5.2 Lapse of withdrawal right — immediate service commencement

At the time of purchase, you are asked to expressly agree that we begin providing your membership and all associated digital membership benefits (such as access to discounted travel offers) immediately and before the 14-day withdrawal period has expired, and to confirm that you are aware that your right of withdrawal with respect to the membership contract lapses once we have provided unrestricted access to the Membership Services (“full performance”) in accordance with § 356(4) BGB in conjunction with § 355 BGB.

5.3 Refund upon valid withdrawal

If you have not consented to immediate commencement or if the service has not yet commenced, we will reimburse all payments received from you within 14 days of receiving your withdrawal notice, using the same payment method as your original transaction.

6. Member Conduct; Membership Benefits

As a Beyond Bagatelle member, you agree to:

The specific benefits included in the membership are described on the Program’s website and in the membership materials provided upon registration. Beyond Bagatelle reserves the right to reasonably modify, replace, or discontinue individual membership benefits if and to the extent this is necessary (i) to reflect the termination or material change of a cooperation with a partner, (ii) to comply with mandatory legal or regulatory requirements, or (iii) to adjust the Program in light of technological or operational developments, provided that the overall nature and value of the Program for the average member is not materially reduced. If any change leads to a more than minor reduction of the overall membership benefits for the current membership term, you are entitled to terminate your membership for cause with effect from the date the change takes effect; any prepaid membership fees for the period after the effective termination date will then be refunded on a pro-rata basis.

Membership benefits are personal and non-transferable, unless expressly agreed otherwise by Beyond Bagatelle.

Exclusive partner offers made available through the Program are subject to the respective partner’s own terms and conditions. Beyond Bagatelle acts as a facilitator and does not assume any liability for the performance of partner services.

7. Event Participation

Membership entitles you to access Beyond Bagatelle events subject to availability. Certain events may require a separate booking or ticket purchase. Membership itself does not guarantee a place at any specific event.

8. Partner Benefits and Third-Party Services

Beyond Bagatelle provides access to benefits offered by third-party partners (hotels, hospitality providers, transport operators, and others). These benefits are provided by the respective partners under their own terms and conditions and are subject to availability.

Unless specifically provided otherwise, Beyond Bagatelle acts as an intermediary in facilitating access to partner benefits and is not a party to any contract between you and a partner. We accept no liability for the quality, availability, or fulfilment of partner services.

Partner benefits may be reasonably modified, suspended, or withdrawn if and to the extent a partnership ends or a partner materially changes the underlying offer. We will take due account of the interests of members and will seek to offer equivalent alternative benefits where reasonably possible. Such changes shall not, by themselves, entitle you to a refund of membership fees as long as, viewed as a whole, the scope and value of the membership benefits for the average Member are not materially reduced. If the end of one or more partner relationships results in a more than minor reduction of the overall membership benefits for the current membership term, you are entitled to terminate your membership for cause with effect from the date the change takes effect; any prepaid membership fees for the period after the effective termination date will then be refunded on a pro-rata basis.

9. Liability

9.1 Limitation of liability

Beyond Bagatelle is liable without limitation for damage caused by intent or gross negligence, for damage resulting from injury to life, body, or health to the extent such have at least been negligently caused by Beyond Bagatelle, and for claims under the German Product Liability Act (Produkthaftungsgesetz).

In cases of ordinary (simple) negligence, our liability is limited to the breach of material contractual obligations (Kardinalpflichten) — i.e. obligations whose fulfilment is essential to the proper performance of the contract and on whose compliance you may regularly rely. In such cases, liability is limited to the foreseeable, contract-typical damage.

9.2 Force majeure

We are not liable for any failure or delay in performance caused by circumstances beyond our reasonable control, including but not limited to natural disasters, acts of government, pandemics, industrial action, or failure of third-party infrastructure.

9.3 Third-party content and services

Insofar as we are not at fault in relation to the selection or organisation of such third-party providers, we accept no responsibility for content, services, or products provided by third-party partners or linked websites. Within the aforementioned scope, use of partner services is at your own risk and subject to the partner’s own terms.

10. Intellectual Property

All content on the Beyond Bagatelle website and platform — including, but not limited to, text, images, logos, videos, and software — is the property of ECD Beyond Experiences GmbH or its licensors and is protected by German and international copyright law. Your membership grants you a limited, personal, non-exclusive, non-transferable licence to access and use the platform for the purpose of utilising your membership benefits. Any reproduction, distribution, modification, or commercial use of platform content without our prior written consent is strictly prohibited.

11. Changes to These Terms

We may amend these Terms & Conditions from time to time where this is reasonable for you, in particular to reflect (i) changes in our services that do not disproportionately affect the overall nature and value of the membership for the average member, (ii) changes in legal or regulatory requirements, or (iii) changes in our business or organisational processes that do not materially alter the balance of rights and obligations under the membership contract. We will inform you of any intended amendment to these Terms & Conditions in text form (e.g. by e-mail to your registered address) at least 30 days before the proposed effective date. The notification will set out the proposed changes in detail and your rights in connection with such changes.

If the changes do not lead to more than a minor reduction in your contractual rights or do not otherwise materially disadvantage you, your continued use of the membership after the effective date will constitute acceptance of the amended Terms. If an intended change would result in a more than minor reduction of your essential contractual rights or would otherwise materially disadvantage you, you may object to the change or cancel your membership free of charge with effect from the date the change would otherwise take effect. In this case, any prepaid membership fees for the period after the effective termination date will be refunded on a pro-rata basis. We will specifically draw your attention to this right of objection / cancellation in the change notification.

12. Final Provisions

12.1 Consumer dispute resolution

With respect to the legislation regulating the settlement of consumer disputes, Beyond Bagatelle points out that it currently does not participate in any such voluntary settlement program. If and to the extent that consumer dispute resolution becomes obligatory for Beyond Bagatelle in the future, Beyond Bagatelle will duly inform the customers affected accordingly in an appropriate manner.

12.2 Governing law

For clients who are not nationals of a member state of the European Union or Swiss nationals, it is agreed that the entire legal and contractual relationship between the client and Beyond Bagatelle shall be exclusively governed by German law. Legal suits filed by clients shall be exclusively brought before the competent court of jurisdiction at the place where Beyond Bagatelle has its registered seat.

12.3 Jurisdiction for claims by Beyond Bagatelle

Claims and lawsuits by Beyond Bagatelle against a client shall be brought before the court of competent jurisdiction at the client’s domicile. In relation to claims and lawsuits against clients who are merchants in accordance with the German Commercial Code (HGB) or legal persons of civil or public law whose residence or registered business domicile or whose usual place of stay is either abroad or unknown at the time when the lawsuit is brought, the parties agree that such lawsuits shall be brought before the court of competent jurisdiction at Beyond Bagatelle’s registered domicile.
